CRIMINAL APPLICATION NO. 454 OF 2015 YOGESH S/O UTTAM PANPATIL
VERSUS
THE STATE OF MAHARASHTRA ...
Advocate for Applicant : Mr. Ghute Suhas B.
APP for Respondent: Mr. R. P. Phatke.
*** CORAM: T. V. NALAWADE, J.
DATED: 17th FEBRUARY, 2015.
PER COURT:
1.
This application is filed for bail. Both the sides are heard. This Court has perused the papers of investigation which mainly includes the transcript of the video shooting of the incident allegedly done by the present applicant. Yogesh Panpatil.
2.
The crime is registered on the basis of report given by Manohar Shankar Panpatil. Deceased was his daughter and she was studying in 10th standard. He has made allegations that, deceased used to disclose that Lakhan was teasing her and he was obstructing her when she used to go to school and return from the school. She committed suicide on 16th
-:(2):- November, 2014 by consuming poison.
3.
During investigation it transpired that present Applicant had done the shooting of the incident of misbehaving of Lakhan with the deceased. The transcript of the said video shooting is made available and the memory card was recovered from the present applicant. In view of the transcript more offences can be added against both the applicants. The record is sufficient to create strong prima facie case that due to such video recording and the conduct of the applicant and Lakhan no other alternative was left before the deceased, who was aged about 18 years, to commit suicide. Such incidents are increasing day by day. No lenient view can be taken in favour of such accused persons. This Court holds that this is not a fit case to grant discretionary relief like bail. There is also possibility of tampering with the prosecution witnesses.
4.
The application is rejected.
