PER COURT :- An application submitted by the petitioner, requesting the District Court to transfer the proceedings of Regular Civil Suit No.100/1991 pending in the Court of Civil Judge, Junior Division, Sangamner, to any other Court outside the Taluka, has been turned down. The reason for transfer is an apprehension harbored by the petitioner that he may not be in a position to prosecute the case properly, since the defendant is a practicing lawyer. The District Judge rightly found the reason to be unconvincing and not a good ground for transfer of the matter. There are no allegations made against the Presiding Officer.

The order passed by the District Judge appears to be reasonable and proper. No interference is called for under extraordinary jurisdiction under article 226 of the Constitution of India. The petition is devoid of substance and as such stands rejected. ( R. M. BORDE, J. ) vbd
