This Application is filed for condonation of delay of 18 days in filing Second Appeal taking exception to the judgment and decree dated 01.09.2023 passed in RCA No. 109/2014.

It is the case of the Applicants that they are agriculturist by occupation and have no other source of income than the agriculture. It is claimed that due to financial constraints, the Appeal could not be filed within a period of limitation. Hence, delay is sought to be condoned.

Learned Counsel for Respondents vehemently opposed the Application.

Perusal of the Application indicates that the delay has been satisfactorily explained. No mala fides can be attributed to the Appellants for not preferring Appeal in time. Hence, Application stands allowed in terms of prayer clause 'B'. Delay stands condoned. Appeal be registered.
