IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.8232 OF 2015 (Anusayabai Gangadhar Patne Vs. The State of Maharashtra and others) Mr.G.L.Awale, learned counsel for the petitioner. (Absent) Mrs.V.N.Jadhav-Patil, learned AGP for the State. ( CORAM : M.S.Sanklecha, J.) DATE : 28/04/2017 PER COURT :

1.

This petition challenges the order dated 12/01/2015 passed by the Additional Collector, Nanded holding that respondent No.4 is a qualified member of the Gram Panchayat at Bavalgaon. 2.

This petition was filed on 25/01/2015. No interim orders were passed in the petition. The petition would now be rendered infructuous as respondent No.4 whose continuance as Sarpanch is challenged, was elected in 2010. Therefore, by efflux of time, the term of the member of the Gram Panchayat would be over and fresh election conducted.

3.

In the above view, the petition is dismissed, as being infructuous.
