ORAL JUDGMENT: ( Per S. V. Gangapurwala, J. ) Rule.

The learned Additional Government Pleader waives notice

927 WP.1333.15.odt of Rule for all the Respondents. With the consent of the learned counsel appearing for the parties, the petition is taken up for final hearing.

Mr. Kendre, learned counsel submits that the Petitioner is deprived of higher pay scale. Representation is given to Respondent No.3, who in turn has forwarded the same to Respondent No.2 and the same is pending with Respondent No.2.

The learned Additional Government Pleader states that in case the same is pending, the Respondent No.2 would take decision on the same on its own merits.

In light of the above, we pass the following order: I.

The Respondent No.2 shall decide the proposal forwarded by Respondent No.3 in case of higher pay scale of the Petitioner, expeditiously, on its own merits in accordance with law, preferably within six months.

II.

Rule is accordingly made absolute in above terms. No costs.
