Learned Advocate Mr. S.P. Katneshwarkar submits that he is appearing for the proposed party. Present applicants are the original plaintiffs and present respondent No.1 is the original defendant No.1. At that time the said bank was made party through its Manager, however, it is said that the bank has gone into liquidation and the Liquidator has been appointed and, therefore, permission is sought to add the Liquidator as party by substituting Manager of respondent No.1. Learned Advocate for the

CA_916_2020 proposed party is having no objection. Under such circumstance, when the bank itself has gone into liquidation, it cannot be represented by its Manager. The substitution is necessary. Hence, this application stands allowed and disposed of.

Necessary amemdment be carried out within the period of one week.

Place the other applications along with Second Appeal on 24.11.2021.
