Learned advocates for the respective sides submit that both these petition have been clubbed together and are being heard together.

Under the orders of this Court dated 05/05/2017, all the litigating sides were called upon to approach the learned Registrar Judicial of this Court for proper verification of the consent terms being settled between the parties. The report dated 05/05/2017 is furnished by the learned Registrar indicating that the consent terms filed by the parties were read over and explained to the litigating sides in vernacular language and they have admitted the same. The consent terms, therefore, were verified in the presence of the parties and their advocates on 05/05/2017.

Shri Sonpethkar, learned advocate for the petitioner in Writ Petition No. 9408/2013 submits on instructions that the petitioner is withdrawing the said petition in the light of the consent terms. The said petition is, therefore, disposed of as withdrawn.

Learned advocates for the respective sides submit that the impugned orders dated 04/08/1999 and 29/10/2012 be set aside by consent and same shall stand replaced by the consent

terms dated 05/05/2017.

Considering the said statements, Writ Petition No. 1597/2014 is allowed by consent and the impugned orders dated 04/08/1999 and 29/10/2012 shall stand set aside by consent to be replaced by the consent terms. This petition is, therefore, allowed in the terms of the consent terms dated 05/05/2017.

The registry is directed to permit the concerned parties to withdraw the amounts as is mentioned in clause '2' of the consent terms.

Pending Civil Applications do not survive and stands disposed of.
