Heard Mr. Karpe, the learned advocate for petitioners. The learned advocate for petitioners submits that, the names of the petitioners were appearing in the provisional voters list. The same have been deleted while preparing final voters list. According to the learned advocate the ordinance issued by the State Government differentiating between members of the society cannot be made on the basis of active and non active members.

Mr. Dighe, the learned advocate for respondent Nos. 2 and 3 submits that, the election programme is declared on 03rd February, 2022 and last date for filing nomination is also over.

In view of the fact that, the election programme is already declared and election process has proceeded further, it would not be appropriate to entertain the present writ petition. The writ petition is disposed of. No cost.

The petitioners may raise plea in appropriate proceedings. In that event all contentions are kept open.
