In 2014, the plot admeasuring 500 sq.mtrs. was allotted to the Petitioner. 10% amount has been paid by the Petitioner and the 90% amount is outstanding. Now, the Petitioner wants a larger plot admeasuring 800 sq.mtrs. For the said purpose, he has filed an application.

The learned Advocate for the Respondents/ Maharashtra Industrial Development Corporation (MIDC) submits that, insofar as the earlier plot admeasuring 500 sq. mtrs., allotted to the Petitioner is concerned, the Petitioner has only assured for the last 10 years that, he is ready and willing to pay

1410.24wp (2) the remainder 90% amount of the price of the plot. However, he has not paid the said amount. As such, the said plot has already been allotted to another buyer. He further submits that, 27 plots indicated at Page No.50 in the Petition paper book, are no doubt industrial plots. However, they are to be sold through auction sale. The Petitioner is at liberty to participate in the auction, whenever it is held.

Considering the above aspects, we are not entertaining this Writ Petition. The same is dismissed.
