Vide the present application, the applicant is seeking withdrawal of the amount of compensation deposited by respondent no.2 in this Court in compliance of the order passed by this Court on 5th September, 2012, in First Appeal No.276/2012. In view of the fact that the First Appeal has been finally disposed of and in pursuance of the order so passed, the amount has been deposited, the applicant is entitled to withdraw the said amount. Learned Counsel for the applicant submits that if the amount deposited in this Court is transmitted to the Motor Accident Claims Tribunal at Jalgaon, it would facilitate the applicant to withdraw the said amount since she is unable to undertake the journey. In view of the submission so made, following order is passed: agp/-

ORDER

1.

The applicant is permitted to withdraw the amount deposited by respondent no.2 in this Court with interest, if any accrued thereon. The amount so deposited in this Court be transmitted to the Motor Accident Claims Tribunal at Jalgaon. The Tribunal at Jalgaon shall remit the said amount to the applicant. Civil Application disposed of.
