The learned Advocate for respondent no.1 has taken objection to the maintainability of the present petition on the ground that the petitioner has alternate efficacious remedy of filing dispute under Section 91 of the Maharashtra Cooperative Societies Act, 1960. 2.

Confronted with such situation, the learned Advocate for the petitioner seeks permission to withdraw the writ petition, with liberty to avail alternate remedy.

The writ petition is disposed of as withdrawn, with liberty as prayed for. Time spent by the petitioner in prosecuting this petition shall be taken into consideration at the time of delay condonation, if any.
