In the present petition, the petitioner has challenged the award passed on 27th of June, 1996, by the first Labour Court, Ahmednagar. Vide the said award, the petitioner was directed to reinstate the respondent as a Majdoor with continuity from 1st of October, 1992, onwards without any backwages. Though the interim relief was sought by the petitioner, it was refused by this Court vide order passed on 4th of September, 2007. Neither Counsel for the respondent, nor the respondent is present. Counsel for the petitioner is also not in a position to state the present status whether the respondent has been reinstated as per the award passed, or otherwise.

Admittedly, the respondent was aged about 45 years when he filed the Reference in the year 1992. It is evident that the petitioner might have retired from the services after attaining the age of superannuation. By passage of time, the petition has become infructuous and hence, stands disposed of.
