Heard the learned counsels for the respective parties. 2.

Learned counsel for respondents stated before the Court that the amount of compensation granted by the Court has been received by him. Hence, nothing is remained to be recovered from him. Both learned counsels for the respective parties state that since the amount of compensation has been paid fully as per the order of the Court, the offence may be compounded.

3. In view of the above statements, it appears that nothing remained to be contested. Hence, the following order :

O R D E R

(i) Criminal Revision Application is allowed.

(ii) Leave granted to compound the offence.

(iii) The orders passed by the learned Judicial Magistrate First Class, Shirpur in S.C.C. No.512 of 2008, dated 26.09.2011 and confirmed by the learned Sessions Judge, Dhule in Criminal Appeal No.87 of 2011, dated 01.01.2014 stand quashed and set aside.

(iv) The applicant/accused is acquitted under Section 255 of the Cr.P.C. for the offence punishable under Section 138 of the N.I. Act.

(v) The surety and bail bond stands cancelled.

(vi) The surety stands discharged.

(vii) Rest of the applications stand disposed of. (viii)The present applicant/accused is entitled to withdraw the amount of Rs.35,000/- lying with the learned Judicial Magistrate First Class, Shirpur, District Duhle.
