Heard learned counsel for the applicant and learned APP for the State.

The injured has been allegedly assaulted on the suspicion of giving tips to the Government about the theft of the sand. There are no allegations against the applicant that he assaulted the injured with a weapon and caused him any injury. His role as alleged was that he slapped the injured and run at him. Considering the role attributed to the applicant, the applicant deserves bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Chetan Rajendra Baviskar, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with

935-ba-181-2023.odt (2) one solvent surety in the like amount in connection with Crime No.518 of 2022, registered with Chopda City Police Station, District Jalgaon for the offence punishable under Section 307, 324, 143, 147, 148, 149, 323, 504 of the Indian Penal Code, on the conditions that ; (a) The applicant shall attend the concerned police station as and when called by the investigation officer on written notice. (b) The applicant shall not tamper with the prosecution evidence.
