ORAL ORDER :

We have heard the learned counsel for the petitioners. The learned counsel submits that the order cancelling the permission granted in favour of the petitioners so also granting permission in favour of respondent No.3 is stayed by this Court

vide order dated 4.9.2000 and the same is continued till date. According to the learned counsel, for the subsequent academic year, the permission was granted in favour of respondent No.3. The same was challenged by the petitioner by filing Writ Petition No.2975/2001 and this Court partly allowed the said Writ Petition in terms of prayer clause (C) and respondent No.3 college was closed down. According to the learned counsel, the college of the petitioner is still functioning pursuant to the interim orders granted by this Court.

We have heard the learned counsel for respondent No.2 University and Mr. Manale, learned counsel for respondent No.3. On being asked by this Court, Mr. Manale, the learned counsel accepts that the order in Writ Petition No.2975/2001, dated 15.9.2010 was passed and it was observed by this Court that respondent No.3 college is closed.

In light of above, there will be no propriety in disturbing the position which is in existence since 15 years. In view of the above, Rule is made absolute in terms of interim orders passed by this Court. No costs.

In view of disposal of the Writ Petition, Civil Application also stands disposed of.
