After hearing learned counsel for parties and on perusal of reasons set out in impugned order, it appears that approach of trial court could seldom be said to be improper at this stage of the matter.

In the circumstances, it does not appear that the order deserves to be intercepted under discretionary powers of this court. Writ petition, therefore, is not being entertained and is rejected, leaving it open for petitioner, if the situation requires, to take recourse to section 105 of the code of civil procedure.
