The order passed by the Labour Court, Jalna in Reference I.D.A. No. 39 of 1993 is challenged in the present petition. The dispute was referred by the present petitioner to the Assistant Commissioner of Labour disputing her termination and seeking her reinstatement. The dispute so made was referred for adjudication to the Labour Court at Jalna and was numbered as Reference I.D.A. No. 39 of 1993. The learned Labour Court rejected the said reference vide the impugned order. 2.

Perusal of the impugned judgment reveals that, since the petitioner could not establish that she had continuously worked in a year for more than 240 days, was not held entitled for any relief as claimed by her in the said reference application. In the present petition no interim relief was granted by this Court, though it was sought for. At the time of referring the dispute, the record

232 wp 4201.98.odt reveals that, the petitioner was aged about 45 years. It is evident that by this time she must have crossed the age of superannuation. Considering the facts as aforesaid, it appears that, nothing survives to be considered in the present petition and by passage of time the petition has become infructuous. The same, therefore, stands disposed of as being infructuous.
