1) The application is filed for relief of anticipatory bail. Both the sides are heard. This Court has perused the papers of investigation which include post mortem report. 2) It appears that in one incident dated 12-1-2015 quarrel took place between the present applicant and one Maruti Dhawade. While the deceased tried to separate the quarrel, elbow of the present applicant hit the chest of the

2 Application 474/2015 deceased. The deceased felt pains in chest. He was shifted to hospital but in the hospital the doctor declared that the deceased Parasram was already dead.

3) The post mortem report show that no wound either of surface or internal was found. The internal organs are preserved for getting expert opinion. 4) In view of nature of allegations this Court holds that some kind of protection needs to be given to the applicant. After receipt of the expert opinion, if the investigating officer decides to arrest the applicant, he should give notice of 72 hours to the present applicant in writing. During this period the applicant may approach the Court for the relief. In those terms the application is disposed of.
