This is an applications seeking condonation of delay of 932 days caused in fling the First Appeal. 2.
Other side has not objection to condone the delay. 3.
Having regard to the reasons stated in the applications, and as parties are arrived at amicable settlement, it is desirable to condone the delay, the delay stands condoned. 4.
Mr. A. M. Phule, learned A.G.P. for the Appellants/State submitted that the above of appeal is squarely covered by the Government Resolution No.
Sankirna-2014/pra.kra.41/Bhag-1/A-4 dated 3rd November, 2016 along with subsequent Corrigendum dated 23rd February, 2017 and 13th August 2018. In turn, this appeal can be withdrawn as per the policy decision taken by the Government of Maharashtra. Accordingly, the State is withdrawing this appeal.

Mr. A. M. Phule, learned Advocate for the State submits that if the amount of compensation is not deposited before this Court or before the Reference Court then the same will be deposited in reference Court, within a period of six months from the receipt of this order. After depositing said amount in the reference Court, the claimants are entitled to withdraw the same. It is further clarifed that, in case, any amount is lying with this Court, then the same shall be transmitted to the reference Court. The reference Court shall disburse the said amount to the original claimants on their applications. The claimants are at liberty to make an application before the reference Court and withdraw the said amount. 6.
The above First Appeal stands disposed of as withdrawn. No order as to costs.

The award be drawn up accordingly. Court fees be refunded to the appellant as per the rules. No order as to costs. 8.
