The learned counsel submits that no contact could be established with the legal heirs of deceased Respondent No.1 / original Complainant so as to find out whether they are interested in continuing with the prosecution. In view of the above statement, the criminal writ petition is disposed of with a liberty to the Petitioners / original Accused to file appropriate application before the Magistrate in pending criminal case R.C.C. No.1877 of 2008. Rule is discharged.
