The applicant-original respondent has preferred this application seeking permission to withdraw the amount of Rs.2,10,000/- deposited by the original petitioner-husband towards interim maintenance awarded by the trial Court.

Learned counsel for the respondent - original petitioner in Revision Petition opposed the application with contention that if the applicant is permitted to withdraw the amount the purpose of filing revision would be frustrated.

Considering the overall facts of the case and the amount deposited is towards

208.21APPLN.odt interim maintenance, I am of the view, the order in following terms would meet the ends of justice. Hence the following order :-

ORDER

(i) The applicant is permitted to withdraw the amount of Rs.2,10,000/- deposited with this Court on furnishing written undertaking to the effect that in the event the Revision is allowed and the order is modified and/or set aside, the applicant shall redeposit the amount within eight weeks from the date of passing of order.

(ii)The application is disposed of in above terms.
