Heard both sides. Learned counsel for the applicant submits that the S.L.A.O. has awarded compensation at the rate of Rs.524/- per R whereas the Reference Court, after relying on five sale instances, submitted by the applicant, awarded the compensation at the enhanced rate of Rs.1054/- per R.

In view of above, the applicant is permitted to withdraw 75% of compensation amount on furnishing undertaking to the satisfaction of Registrar (Judicial) of this Court.

The remaining 25% amount shall be invested in any Nationalized Bank initially for a period of three years and the fixed deposit be renewed thereafter from time to time until further orders. Civil application is accordingly disposed of. ( V. K. JADHAV, J.) rlj/
