The learned counsel for the petitioner in WP No. 3401/2025 seeks leave of this Court to delete prayer clause 'C'. Leave is granted. Deletion be carried out forthwith.

Heard the learned counsel for the parties.

Both the parties agree that the matter can be remanded to the Industrial Court for reconsideration as the grievance of the complainant is that the compensation of lump-sum amount granted of Rs.8,00,000/- is insufficient and the complainant should have been granted reinstatement and backwages whereas the grievance of the Maharashtra State Road Transport Corporation is that the dismissal order should be maintained. 4.

Considering that both the parties are aggrieved by the impugned order, I deem it appropriate to quash and set aside the impugned order passed by the Industrial Court and remand the matter back to the Industrial Court.

In view of the above, the impugned order dated 1.8.2024 passed by

WP 4301/25 & Anr.

the Industrial Court in Revision ULP No. 35/2023 is quashed and set aside. The matter is remanded back to the Industrial Court to decide Revision ULP No. 35/2023 filed by the MSRTC and Revision ULP No. 52/2025 filed by the complainant for fresh decision. The amount deposited in this Court be remitted back to the Industrial Court. All contentions are left open. The writ petitions are disposed of accordingly.
