Learned District Judge-1, Nanded, vide letter dated 15.03.2018 has communicated to the Registrar (Judicial) of this court that respondent no.4 herein namely Subhash Shamrao Kadam has filed pursis for withdrawing his Election Petition no.8 of 2002. The learned District Judge-1, Nanded has verified the contents of the pursis filed by the respondent no.4 herein. However, reported the filing of the pursis to this court for the reason that the present writ petition is pending wherein the Rule has been granted and the further proceedings in the election petition have been stayed.

Learned counsel for the petitioner submits that in the light of the report submitted by District Judge-1, Nanded this petition may be disposed of as infructuous.

Since respondent no.4 has filed the pursis for withdrawing Election Petition no.8 of 2002 before the learned District Judge-1, Nanded and the learned District Judge-1, Nanded has also verified the contents of the pursis, the cause for filing the Writ Petition No.1537 of 2003 has been rendered infructuous and the writ petition is accordingly disposed of as infructuous. Rule discharged. 4.

Learned counsel for the petitioner in Writ Petition No. 3163 of 2003, seeks leave to withdraw this writ petition for the reasons that the petitioner has filed the pursis before the court below for withdrawing the Election Petition no. 8 of 2002 and this court has also disposed of Writ Petition no.1537 of 2003 on the similar grounds. Leave granted. Writ Petition no.3163 of 2003 is disposed of as withdrawn. Rule discharged.
