The petitioner had not contested the election against the respondent. The petitioner is challenging the validity granted to the respondent on the ground that his wife has contested the election against the respondent in question i.e. of the Gram Panchayat.

Only because the petitioner claims to be belonging to the caste of the respondent, would not give any right to challenge the validity issued, the petitioner cannot be said to be an aggrieved party. If an aggrieved party approaches this Court, we may consider the case on its own merits.

With these observations, the writ petition is disposed of. No costs.
