PER COURT :- 1.

It is undisputed that the order of the Tribunal dated 28.8.2015 is at issue in this Contempt Petition. There is no order passed by this Court with regard to the proceedings arising out of the judgment of the School Tribunal dated 28.8.2015.

Considering the law laid down in the matter of Shaikh Badrunnisa Begum Vs. State of Maharashtra [2004 (2) Mah.L.J. 407] and in the light of the availability of Section 13 of the MEPS Act, this Contempt Petition is not being entertained and is disposed off. 3.

Needless to state that since the judgment of the School Tribunal has not been stayed by this Court, the petitioner will be at liberty to take recourse to the execution proceedings.
