The applicants have prayed for condonation of delay of 1408 days caused in filing the first appeal. The applicants are original claimants, whose land is acquired.

For the reasons stated in the application, this Court is inclined to allowed application. Therefore, this application is allowed and the delay is condoned subject to deposit of Rs.1000/- (Rupees One Thousand) to be paid for the purpose of High Court Dispensary. The applicants shall also file an undertaking that in-case the appeal is allowed, the applicants shall not be entitled to claim interest for the delayed period on the enhanced amount.
