2] The applicant who is the wife of the respondent is seeking transfer of Marriage Petition No.A-356/2020 filed by the respondent in the Family Court at Nashik under Section 9 of the Hindu Marriage Act to the Family Court at Aurangabad on the ground that she is in the employment of a bank and 6 year old girl child of the couple is in her custody making her difficult to commute between Aurangabad and Nashik. 3] The learned advocate Mr.Joshi for the respondent husband on instructions submits that the matter may be transferred to Aurangabad, however it may be directed to be expedited.

4] The application is allowed. Marriage Petition No.A-

43-mca40-21.odt 356/2020 stands transferred to the Family Court at Aurangabad. The parties to appear before the Court at Aurangabad on 18/12/2021 and there shall be no need for that Court to issue any notice to them.

5] On such transfer, the Family Court, Aurangabad shall decide the Petition as early as possible and in any event within a period of 6 months.
