Heard. The contention is that, after measurement of the suit land by the Government Surveyor, original defendants made some encroachment on the suit land. The suit, however, is filed only for declaration and injunction simplicitor. There is no prayer for removal of encroachment. In fact, removal of encroachment over any portion of the suit land is not an issue if the land in question has already been measured by the Government Surveyor. In these circumstances, I find no merit in the petition. The petition is dismissed summarily with costs. ( S. B. SHUKRE ) JUDGE fmp/wp2657.17
