There is no dispute about the fact that the original proceeding bearing HMP No. 249/2018 was dismissed for want of prosecution on 24.08.2023. Though this Court is informed that the husband has filed restoration application to restore the said proceeding, till date the proceeding is not restored. 2.

The present application is pending since 2020. There is no guarantee that the original proceeding will get restored on the application filed by the respondent. Hence, application is disposed of with liberty to the applicant to file fresh application, if necessary. ( R. M. JOSHI) Judge dyb
