This application is for bringing heirs of Respondent No.1 - Sandu Kachru Salve and Respondent No.4 - Ashok Kachru Salve on record. There is delay in preferring this application for bringing heirs on record and setting aside the abatement. The cause of action survives against the heirs proposed to be brought on record. The First Appeal is yet to be decided finally.

For the reasons stated in the application, I am inclined to condone delay and allow the application.

The Civil Application is allowed in terms of prayer clause 'B' and 'C'.
