It is submitted that an amount of Rs.13,22,980/- (Rupees thirteen lacs twenty two thousand nine hundred eighty only) was sanctioned for construction of work of Women's Hostel as per the scheme. The petitioner has spent the amount for construction. According to the learned counsel, because there were few admissions of girl students the part of the building was utilised for the purpose. According to the learned counsel, the petitioner is ready to pay principal amount, however, some time be granted to the petitioner. As per order of the Court, the petitioner has already paid Rs.4,00,000/- (Rupees four lacs).

We have heard learned Asstt. Govt. Pleader also and the learned counsel for Union of India.

The petitioner has deposited an amount of Rs.4,00,000/- (Rupees four lacs only) as directed by this Court. Considering the difficulty shown, we grant one year's time to the petitioner to pay the remaining amount out of Rs.13,22,980/- (Rupees thirteen lacs twenty two lacs nine hundred eighty only) with simple interest at the rate of Rs.6% p.a.

In the result, we pass the following order :

a) The petitioner shall pay the remaining amount of Rs.9,22,980/- (Rupees nine lacs twenty two thousand nine hundred eighty only) with simple interest at the rate of Rs.6% p.a. within a period of one year in four equal quarterly instalments. The Respondent is entitled to withdraw Rs.4,00,000/- (Rupees four lacs only) deposited by the petitioner.
