The learned counsel for respondent nos.3 and 4 on instruction states that, his client would re-invite the tender for construction of C. C. Nala in Ward No.1 Raviwar Peth from Janulla House to Miliya School for Municipal Council, Ambejogai. The statement is accepted. As and when any fresh tender is invited, the petitioner as well as respondent no.5 and any other bidders eligible to apply for such tender shall be allowed to participate in the tender. In view of the statement made by the learned counsel for respondent nos.3 and 4, nothing survives in this petition.

It is made clear that, in view of the statement made by the learned counsel for respondent nos.3 and 4, we have not gone into the merit of the action on the part of respondent nos.3 and 4 in this petition.
