The matter was argued for sometime. The learned counsel for the petitioners invited our attention to the application dated 19.01.2017 filed by the petitioners to the Collector Beed and SubDivisional Officer, Patoda regarding objections to the apportionment of the compensation amongst the interested persons in respect of Gut Nos.577, 564, 278, 563 and 561 situated at village Gomalwada, Taluka Shirur (Kasar), District Beed under Section 30 of the Land Acquisition Act, 2013 contending that the petitioners are the only owners and interested persons in those lands and none other persons are entitled for any compensation for the said acquired land. The petitioners have requested the Collector and Sub-Divisional Officer to disburse the amount of compensation for the acquired land. He 1/2

5-wp-1422 OF 2022.odt submits that the said application is still pending before the Collector and Sub-Divisional Officer.

We accordingly direct the Collector and Sub-Divisional Officer to decide the said application within eight weeks from today. It is made clear that this Court has not expressed any views on the merits of the application and the entitlement of the petitioner, if any, for payment of compensation as claimed in the said communication dated 19.01.2017.

All contentions of both the parties are kept open. The order that would be passed by the Collector and Sub-Divisional Officer shall be communicated to the petitioners within one week from the date of passing of the order.
