1] Heard learned counsel for the parties.

2] The joint affidavit filed by the parties is accepted and marked as Exhibit X for the purpose of identification.

3] Shri Shamrao Krishnrao Dhepe - appellant no.2, who is present in the Court, agrees to the contents of the joint affidavit - Exhibit X and states that he would be sending draft of Rs.50,000/- per month by Registered Post

FA 321/00 - 2 - Acknowledgement Due to the respondent - Mahadeo Bajirao Darade, as agreed in the present settlement till the satisfaction of the agreed amount of Rs.2,00,000/-. 4] Advocate Shri S.S. Jadhavar submits that the respondent - Mahadeo Bajirao Darade is 80 years old and his leg is amputed and is unable to attend the Court. The joint affidavit shows that he has also signed and sworn the same.

5] In that view of the matter, the settlement arrived at between the parties is recorded. The appeal is allowed in terms of the settlement. The decree be drawn up accordingly. In view of the settlement, Civil Application No.4638/2000 does not survive and disposed of as such.
