1. We have heard learned Advocate appearing for the petitioner. Learned Advocate submits that pursuant to the advertisement, the petitioner applied for the post of Constable (General Duty). Form of the petitioner was accepted. The petitioner participated in the selection process and eventually, the petitioner was declared ineligible on the ground of age. Learned counsel submits that if the petitioner was ineligible on the ground of age, the application of the petitioner ought not to have been accepted. As the application of the petitioner was accepted, the condition of age was relaxed. The respondents be directed to issue appointment orders to the petitioner.

The advertisement prescribes that candidate should not have been born earlier than 02.08.1988 and not later than 31.07.1993. The petitioner is born on 02.10.1984. The petitioner, as per the advertisement, was over aged and could not have been considered. No error on the part of the respondents in rejecting the candidature of the petitioner. 3.
