The Petitioner's brother in law received a Plot A-76 in MIDC, Osmanabad. He then leased it out to the present Petitioner. While leasing it out, he had erected some construction on the said plot to suit his plan for erecting a textile factory. The Petitioner entered into a lease agreement with her brother in law. Now she submits that she wants to construct a factory for processing liquid oxygen gas and the said plot with the construction is not suitable. However, she does not want to let go the said plot and in addition, prays for an additional plot. 2.

In view of the above, we do not intend to issue any writ of mandamus to the MIDC. It is at liberty to deal with the pending

17wp1245-24 application of the Petitioner dated 20.10.2021 on it's own merits and in the light of the Rules and Policies applicable. 3.
