This is an application by the applicant for withdrawal of the amount of Rs.1,25,000/-, which is deposited by respondent no.1 in this Court.

Present applicant has filed Criminal Appeal No.1146 of 2019 challenging the judgment and order passed by JMFC (Court No.2), Patoda, Dist.Beed on 06-07-2019 in SCC No.24 of 2012 by which present respondent no.1 was acquitted from charge under Section 138 of the Negotiable Instruments Act.

During pendency of the appeal, it is stated that respondent no.1 has deposited disputed amount of Rs.1,25,000/- in this Court on 01-01-2024 and it is reported that the matter has been amicably settled. Therefore, by order dated 12-01-2024, by recording such statement made by both the parties, appeal came to be disposed of.

On perusal of record, it seems that Rs.1,25,000/- is already deposited by respondent no.1 in this Court. Other side orally submitted that there is no objection for withdrawal of the said amount.

In view of the above, the application is allowed in terms of prayer clause (B) and disposed of accordingly. ( ABHAY S. WAGHWASE ) JUDGE SPT
