1) The application is filed for grant of bail. Both the sides are heard. This Court has perused papers of investigation.
2) Previous application, Criminal Application No. 6693/2013, filed for bail was rejected by this Court on bail on 13-2-2014. Direction was given to the trial Court to
2 Application 507/2015 expeditiously dispose of the case and in any case within nine months from the date of receipt of the said order. Learned counsel for the applicant submitted that no progress is made in the matter and so the applicant is entitled to get bail. He submitted that the applicant has been behind the bars for four years in the case and so on that ground he is entitled to get bail.
3) There is one more order made by this Court (other Hon'ble Judge) in Criminal Writ Petition No.1448/2014. It shows that prayers were made for issuing directions of different nature including prayer to grant of bail in the writ petition. This Court had called the report of the Presiding Officer and the report showed that the accused persons were playing delaying tactics and due to that even charge could not be framed by the Court. This Court has observed that no fault can be found on the part of the prosecution and the writ petition was rejected by this Court.
4) It appears that there are in all 13 cases filed against the present applicant of similar nature. In any
3 Application 507/2015 case, in view of the provisions of M.C.O.C Act, priority will be given to the present case by the trial Court. Thus, the circumstances are not changed. In the result, the application stands rejected.
