Despite our order dated 07.03.2022, appointing Mr. Chaitnya Deshpande, learned counsel to represent respondent no.2, the Secretary, High Court Legal Services Sub-Committee, Aurangabad has inadvertently appointed learned counsel Smt. Rekha Ladda. 2.

In view of the same we discharge the appearance of learned counsel appointed by the Secretary, High Court Legal Services SubCommittee, Aurangabad. 3.

Learned APP submits that after filing of this criminal appeal, charge-sheet has been submitted and the order impugned in this appeal came to be passed prior to filing of the charge-sheet.

In view of the above statement, learned counsel for the appellants, on instructions, seeks leave to withdraw this appeal with liberty to the appellants to file an application for regular bail before the trial court on filing of the charge-sheet. 5.

Leave granted. The criminal appeal is hereby dismissed as withdrawn with liberty to each of the appellants to file an application for regular bail before the trial court on filing of the charge-sheet, and upon filing of such application, the trial court shall decide the same on its own merits, as expeditiously as possible. 6.

We quantify the fees for the appointed counsel at Rs.2,000/- (Rupees Two Thousand only) to be paid by the High Court Legal Services, Sub-committee, Aurangabad.
