IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.1752 OF 2018 Ashok Namdeo Bhujang and Others PETITIONERS

VERSUS

Kalyan Namdeo Bhujang RESPONDENT [CORAM : MANJUSHA DESHPANDE, J.] DATE : 7 th JANUARY, 2025 ORDER :

1.

While disposing of Writ Petition No. 1752 of 2018, on 18th June, 2018, this Court has directed to expeditiously proceed with the suit and dispose it of preferably within a period of nine months.

2.

Thereafter, extension of time was granted by this Court twice, by orders dated 14th June, 2019 and 8th May, 2024. Present request by Civil Judge Junior Division, Gangapur for extension of time is made by giving reason that though the matter was proceeded on day to day basis the evidence of the Plaintiff is closed on 4th December, 2024. The matter is posted for evidence of Defendant and the Defendant is partly examined, however, since the suit is strongly contested, further extension of time for 6 months is sought for disposal of the suit.

{2} wp1752-18.doc 3.

Considering the fact that already twice extension of time for 6 months was granted by this Court, in my opinion, it would be appropriate to grant further 3 months' time to decide the suit. Accordingly, 3 months' further extension is granted to decide the suit.
