This is an application for suspension of substantive jail sentence and for grant of bail. This Court has admitted the present Revision Application. The applicant is convicted for limited duration. The learned counsel for the applicant submitted that on the basis of record, it is clear that the applicant has already surrendered before the learned

2 Cr. Apln. 522.2015 in Cr. Revn. Apln. 18. 2015 Magistrate. The statement is accepted.

During the pendency of the proceedings before the Magistrate, also before the appellate Court, the applicant was on bail and at no point of time he has mis-used the liberty granted.

In that view of the matter, I pass the following order :

(1) The present Criminal Application is hereby allowed.

(2) The substantive jail sentence imposed upon the applicant by the learned Judicial Magistrate First Class, Ambajogai on 30/05/2007 in R.C.C. No. 79/2006 together with the confirmation of said substantive jail sentence passed by the learned Additional Sessions Judge, Ambajogai on 10/12/2014 in Criminal Appeal No. 40/2007 is hereby suspended. During the pendency of the present Criminal Revision Application, the applicant Shivaji S/o Babruwan Jagtap shall be released on bail, on he executing P.R. Bond of ` 10,000/- [Rupees Ten Thousand only] with 2 solvent sureties of like amount. (3) The applicant shall remain present in this Court at the time of final hearing.
