ORDER :

The application is filed for bail. Both the sides are heard. This Court has perused the papers of investigation. 2.
The crime is registered on the basis of report given by one Police Officer of Vigilance Branch. It appears that there was information that there was incidents of cow slaughtering and due to that there was tension between two communities. Police went there to take action. Allegations are made that police personnel were attacked by the persons of the community of the present applicant. Allegations are made that one of the person of the said mob snatched mobile handset of the complainant, police officer.

The learned APP submitted that the aforesaid mobile handset was recovered at the instance of present applicant. The learned APP submitted that applicant has no record of bad antecedents showing that he was involved in the theft cases in the past. In view of the nature of dispute and the fact that he has been behind bars since 8.1.2015, this Court holds that it is not desirable to keep the applicant behind bars till the disposal of the case. The crime is registered for the offences punishable under sections 394, 149 etc. of I.P.C. and some other sections. 4.
In the result, the application is allowed. The applicant is to be released on bail on his furnishing PR and SB of Rs. 15,000/- (Rupees fifteen thousand). He is not to tamper with the prosecution witnesses. He is not to commit similar offence. [ T.V. NALAWADE, J. ] ssc/
