PER COURT :- The petitioners are praying for issuance of directions to respondents, not to acquire the land Gut No.164 situate at Rui (Pimpla) Tq. Wadvani, District Beed, for the purpose of rehabilitation of the villagers.

An affidavit in reply has been presented on behalf of respondent No.1 State of Maharashtra by Tahsildar, Wadvani. It is clarified in paragraph No.6 of the reply that, the instant petition is presented by the petitioners, on the basis of the inspection report. It is further stated that, the land Gut No.164 is not proposed for acquisition and the lands Gut Nos. 178, 179, 180, 181, 184 and 185 have already been acquired by the State Government and the

{2} wp 1605.15.odt proceedings in respect of acquisition of the said lands are also completed. Since there is no proposal in respect of acquisition of the land Gut No.164, the grievance is based merely on the apprehension and no order as requested by the petitioners need be passed.

Considering the contentions raised in the affidavit in reply, writ petition stands disposed of.
