Applicant apprehends arrest in C.R. No. 1058 of 2023, registered with Rahuri Police Station, Dist. Ahmednagar for offence punishable under section 395 of Indian Penal Code. 2.

FIR is lodged by Sudarshan Gite alleging commission of robbery at his house by six unknown persons on 15/09/2023 at 01.00 am and by putting inmates of informant's house under fear of causing injury by means of knife. Gold ornaments and cash amount worth Rs. 2,10,000/- was robbed. During the course of investigation it was transpired that applicant has helped main accused persons in disposing of the stolen articles. Bhagyawant Punde

Heard learned advocate for applicant and learned APP for State. Perused the investigation papers. 4.

There are no criminal antecedents against applicant. Main accused are arrested and stolen articles are recovered. Similarly situated co-accused are already granted anticipatory bail by this Court in Anticipatory Bail Application No. 2085/2023. During the course of investigation, no incriminating material is found against the present applicant. Investigation is almost complete. Custodial detention of applicant is therefore not necessary in the facts of the present case.

Anticipatory Bail Application No. 142/2024 is therefore allowed by confirming the interim protection granted to applicant vide order dated 29.01.2024.

Till filing of charge sheet, applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation. Applicant shall not tamper the prosecution evidence.
