This Court by order dated 6th November, 2023, allowed the Applicants to withdraw 50% of the amount deposited along with the interest accrued on furnishing usual undertaking before the Registrar (Judicial) of this Court and remaining 25% of the deposited amount along with accrued interest on furnishing solvent surety. The remaining balance amount was directed to be deposited in FDR during the pendency of these Appeals.

It is submitted by the learned Advocate for the Applicants that since the Applicants were not able to furnish the Solvent Surety, they have approached the concerned authority i.e., the Collector and have secured the Solvency Certificate on their own. He submits that the Applicants be allowed to furnish the Solvency Certificate by themselves instead of Solvent Surety. He submits that this Court has passed an Order in Civil Application No. 1938 of 2023 and connected Applications allowing the Applicants therein to furnish the Solvency Certificate of their own.

Learned Advocate for the Acquiring Body submits that, an appropriate order be passed.

We have gone through the order dated 9th January, 2025 passed in Civil Application No. 192 of 2025 in Civil Application No. 12283 of 2023 in First Appeal No. 2784 of 2023. We see no impediment
3 925to927CA1208.2025.odt in allowing the Applications and hence, they are allowed in terms of prayer clause 'B'. The Civil Applications stand disposed of. The learned Advocate for the Applicants undertakes that the Applicants will approach the concerned Competent Authority for making the necessary entries in the regular record regarding this encumbrance.
