Heard learned Counsel - Mr. S.S. Shinde for the petitioner and learned A.G.P. for respondent Nos.5, 6 and 7, State Authorities. 2.

The petitioner challenges the order dated 27.12.2017 passed by the Additional Divisional Commissioner, Aurangabad in Case No. ROR/REV/82/2013, the order dated 24/12.2012 passed by the Additional Collector, Osmanabad in Case No. 2012/RTS/59/131 and order dated 07.07.2012 passed by the Sub Divisional Officer, Osmanabad in File No. 2011/APPEAL/KAWI-705, whereby the application for condonation of delay was rejected.

Learned A.G.P. for respondent Nos.5, 6 and 7, State Authorities raised a preliminary objection about the maintainability of the present

2 27 WP 12392-2022.odt petition that the petitioner has an alternate remedy of filing the revision before the State Government.

In view thereof, the Writ Petition is disposed of as not maintainable.

The petitioner is at liberty to file a revision before the State Government within a period of six (6) weeks from today. If the petitioner files revision, the same shall be decided within a period of months (6) months from today.

The delay caused in prosecuting the present petition shall be taken into consideration by the State Government while considering an application for condonation of delay.

7.

All the points are kept open.
