Heard learned counsel for the applicant and learned APP for the State.

The offence under Section 326, 324, 323, 504, 506 of the Indian Penal Code has been registered against the applicant. The alleged weapon used in the crime has been seized. The applicant has undergone the police custody remand. Now he is under the Magisterial custody. Considering the material progress in the investigation and the nature of dispute, it would be inappropriate to keep the applicant behind bar. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Ismail Shaikh Kureshi, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime No.9

960-ba-214-2023.odt (2) of 2023, registered with Upnagar Police Station, District Nandurbar for the offence punishable under Section 326, 324, 323, 504, 506 of the Indian Penal Code, on the conditions that; (a) The applicant shall not contact the injured or any witness till the conclusion of the trial.

(b) The applicant shall attend the concerned police station as and when called by the investigation officer on written notice till filing the charge sheet.
