Mr. Bhosale, the learned counsel for the petitioner states that, against the decree passed by the Trial Court in R.C.S. No. 35 of 2012, the petitioner has filed an appeal before the District Court. Along with appeal, the petitioner has filed petition for stay. Same is pending from January 2016. The parties are served, however stay petition has not been decided. 2.

Naturally, when the stay petition is filed before the District Court, the District Court is expected to decide the same. We hope and trust that, the District Judge shall decide the stay
