By this application, the appellant / husband prays for condonation of delay 122 days delay caused in filing the appeal. 2.

The delay is neither deliberate nor inordinate. For the reasons set out, the civil application is allowed and the delay is condoned.

With regard to the Family Court Appeal St. No. 2764 of 2023, the same be registered in the light of the orders passed today on the Civil Application No. 3388 of 2023.

At the request of the learned advocate for the respective sides, the Registry is directed to refer this case to Smt S T Kazi, trained Mediator at the High Court. The learned advocates are at liberty to contact the learned Mediator for an early initiation of mediation process. After the mediation is concluded and the report is submitted, parties are at liberty to circulate the appeal.
